This Privacy Policy describes how Stems and More LLC, a Wyoming limited liability company doing business as "@flowers" ("@flowers," "we," "us," or "our"), collects, uses, discloses, and protects information in connection with the website located at atflowers.com, together with any related pages, subdomains, forms, tools, and services that link to this Privacy Policy (collectively, the "Site"). This Privacy Policy does not apply to any separate platform operated by @flowers that is accessed through a partner login or that is governed by a different privacy notice.
By using the Site or by providing information to us through any channel described below, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Site and do not provide us with any information.
1. Scope and Who We Are
Stems and More LLC is the data controller responsible for information collected through the Site. Our principal mailing address is 1621 Central Ave #63556, Cheyenne, WY 82001. You can contact us about privacy matters at [email protected].
The Site is a business-to-business marketing and informational platform directed at florist businesses located in the United States. The Site is not directed at individual consumers purchasing flowers and is not directed at children.
2. Information We Collect
We collect information about you and your business from three sources: (a) information you provide directly to us, (b) information collected automatically when you interact with the Site, and (c) information we receive from third parties and publicly available sources.
2.1 Information You Provide
When you submit an inquiry form, email us, call us, message us on social media, or otherwise communicate with us, you may provide information including: your name; your business or shop name; your business and personal email addresses; your business and personal phone numbers; your mailing and physical addresses; the city, state, and ZIP code of your business; your title or role; information about whether your business is active on third-party delivery platforms; any message, question, or additional information you choose to include; and any other information you provide in the course of communicating with us.
2.2 Information Collected Automatically
When you visit the Site, we and our service providers may automatically collect information about your device and your interactions with the Site, including: your Internet Protocol (IP) address; approximate location derived from your IP address; device type, operating system, and browser type; referring and exit pages; the pages and content you view; the dates and times of your visits; the actions you take on the Site; and similar technical and usage information. We currently use Plausible Analytics, a privacy-focused, cookie-free analytics service, to collect aggregated Site-usage information. We may add, remove, or replace analytics and tracking providers at any time, as described in Section 4.
2.3 Information From Third Parties and Public Sources
We may also receive information about you or your business from third parties, including: social media platforms when you interact with our accounts or posts; business directories, public records, mapping services, and publicly available websites; referral partners, trade associations, and industry contacts; third-party delivery platforms and similar marketplaces; lead generation, data enrichment, and sales intelligence providers; advertising and marketing partners; and any other third party that lawfully provides us with information about you or your business. We may combine information received from third parties with information we collect directly from you.
3. How We Use Information
We use information we collect for any lawful business purpose, including without limitation to: (a) operate, maintain, secure, and improve the Site; (b) respond to inquiries and provide customer and partner support; (c) identify, evaluate, qualify, and contact potential and existing partner businesses; (d) send marketing, sales, promotional, educational, and relationship communications through any channel described in Section 4; (e) develop, test, and improve our services, products, and marketing; (f) conduct research, analytics, and market analysis; (g) personalize content, recommendations, and offers; (h) measure the performance of our marketing and advertising; (i) prevent fraud, enforce our Terms of Service, and protect our rights and the rights of others; (j) comply with applicable laws, regulations, legal process, and lawful requests from government authorities; and (k) any other purpose disclosed to you at the time of collection or with your consent.
4. Communications With You
When you provide us with contact information, or when your business contact information is available to us from any lawful source, you agree that we and our authorized representatives, service providers, and agents may contact you through any reasonable means for any business purpose, including marketing, sales outreach, partner recruitment, account servicing, relationship management, and customer support.
Authorized methods of contact include, without limitation: (a) telephone voice calls, whether placed manually or using automated technology; (b) SMS, MMS, RCS, iMessage, and any other text messaging protocol, whether sent manually or through automated systems, and whether sent to mobile or landline numbers; (c) email, including marketing and transactional email; (d) direct messages, comments, replies, mentions, and in-platform messages on any social media, messaging, or professional networking platform on which you or your business maintain a public or business account, including without limitation Instagram, Facebook, LinkedIn, TikTok, X (formerly Twitter), YouTube, Pinterest, WhatsApp, Threads, Snapchat, Reddit, and any successor or similar platform; (e) postal mail; (f) in-app notifications, push notifications, and web-based chat; (g) fax; and (h) any other electronic, wireless, or physical means of communication now known or later developed. You acknowledge that message and data rates may apply to any wireless or text communications, that messages from us may be recurring, and that you are responsible for any charges from your wireless carrier.
Where required by applicable law, we will obtain your consent before sending certain categories of communications, such as marketing text messages to mobile numbers in the United States. You may opt out of marketing communications at any time by (i) replying STOP to any marketing text message; (ii) clicking the unsubscribe link in any marketing email; (iii) asking the caller to stop calling during any marketing voice call; or (iv) emailing [email protected] with the word "Unsubscribe" in the subject line. Even after you opt out of marketing communications, we may continue to send you transactional, administrative, relationship, or legally required communications related to any active business relationship.
5. Cookies, Tracking Technologies, and Advertising
We and our service providers, advertising partners, and analytics providers may now or in the future use a wide range of tracking technologies in connection with the Site and our marketing activities. These technologies include, without limitation: first-party and third-party cookies; Flash cookies and other local storage; web beacons, tracking pixels, clear GIFs, and tracking tags (including but not limited to the Meta Pixel, Google Tag, LinkedIn Insight Tag, TikTok Pixel, Pinterest Tag, X Pixel, Reddit Pixel, and any similar technology); software development kits (SDKs); session replay and heat-mapping tools; device fingerprinting and browser fingerprinting; cross-device, cross-context, and cross-application identifiers; server-side tracking, conversions API (CAPI), and offline event uploads; mobile advertising identifiers (IDFA, GAID); probabilistic matching and identity resolution; and any other tracking, analytics, attribution, measurement, targeting, or advertising technology now known or later developed (collectively, "Tracking Technologies").
We and our partners may use Tracking Technologies to: (a) recognize you and your device across visits and sessions; (b) understand how you and others use the Site and our marketing content; (c) measure the performance of our advertising, content, and marketing campaigns; (d) attribute conversions and optimize our marketing spend; (e) serve you interest-based, behavioral, contextual, retargeted, and remarketed advertising on the Site and on third-party websites, apps, and platforms, including social media platforms; (f) build, match, and share custom audiences, lookalike audiences, and similar marketing audiences with advertising platforms; (g) personalize content, offers, and recommendations; (h) conduct analytics, research, fraud prevention, and security monitoring; and (i) any other purpose described in this Privacy Policy or permitted by applicable law.
By using the Site, you consent to our use of Tracking Technologies for the purposes described above, except where additional consent is required by applicable law. Where additional consent is required, we will obtain it through a consent banner or similar mechanism before activating the relevant technology. You may be able to control certain Tracking Technologies through your browser settings, device settings, or industry opt-out tools such as the Digital Advertising Alliance (optout.aboutads.info), the Network Advertising Initiative (optout.networkadvertising.org), the European Interactive Digital Advertising Alliance (youronlinechoices.eu), and advertising platform opt-out mechanisms (such as adssettings.google.com). We are not responsible for the effectiveness of any third-party opt-out mechanism, and opting out does not stop all data collection or advertising; it only affects whether the advertising is personalized to you.
We currently do not respond to "Do Not Track" browser signals because no industry consensus has formed around how to interpret them. If and when we receive a legally recognized opt-out preference signal, such as a Global Privacy Control (GPC) signal, from a resident of a jurisdiction that requires us to honor it, we will treat it as a valid opt-out of the sale or sharing of personal information for that browser, to the extent required by law.
6. Payment Information
@flowers does not collect, process, store, or transmit credit card numbers, debit card numbers, bank account numbers, ACH credentials, wire instructions, cryptocurrency wallet information, or any other payment account information through the Site. All payment processing related to @flowers services — including partner payouts, platform fee collection, and any tablet or subscription billing — is performed exclusively by Stripe, Inc. ("Stripe") through Stripe's Connect platform. Stripe is an independent third party and is solely responsible for the collection, processing, storage, and security of payment account information, as well as for all related know-your-customer (KYC), know-your-business (KYB), anti-money-laundering (AML), sanctions screening, fraud prevention, tax reporting, and other financial and regulatory compliance obligations.
When you establish a connected account with Stripe in connection with @flowers services, you provide information directly to Stripe under Stripe's own terms and privacy policy, available at stripe.com. We may receive limited, non-sensitive information from Stripe related to your connected account — such as your account status, payout history, and identifiers — for operational purposes. We do not receive or store full card numbers, full bank account numbers, or other sensitive payment credentials.
7. How We Share Information
We do not sell your personal information in exchange for monetary consideration. We may share information in the following circumstances:
- Service providers. We share information with third-party vendors and service providers who perform services on our behalf, such as website hosting (Kinsta), workflow automation and integration (Zapier), analytics (Plausible), email, customer relationship management, productivity and collaboration tools (including Google Workspace), payment processing (Stripe), marketing, advertising, and similar services.
- Advertising and marketing partners. We may share information with advertising networks, social media platforms, and marketing partners to serve, measure, and optimize advertising, including interest-based and retargeted advertising. Depending on the jurisdiction, these disclosures may be considered "sharing" or a "sale" of personal information under applicable privacy law.
- Affiliates and successors. We may share information with affiliated entities under common ownership or control, and in connection with any merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our assets.
- Legal and safety. We may disclose information when we believe disclosure is necessary to comply with law, legal process, or enforceable governmental request; to enforce our Terms of Service; to detect, prevent, or investigate fraud, security, or technical issues; or to protect the rights, property, or safety of @flowers, our partners, our users, or others.
- With your direction or consent. We may share information at your direction or with your consent.
- Aggregated or de-identified information. We may share aggregated or de-identified information that cannot reasonably be used to identify you for any lawful purpose.
8. Data Retention
We retain information for as long as needed to fulfill the purposes described in this Privacy Policy, to maintain business records, to pursue legitimate business interests, to comply with legal obligations, to resolve disputes, and to enforce our agreements. Retention periods vary based on the type of information, the context in which it was collected, and applicable law.
9. Your Privacy Rights
Depending on where you live, you may have certain rights with respect to the personal information we hold about you. These rights may include: the right to know what personal information we collect about you; the right to access or receive a copy of your personal information; the right to correct inaccurate personal information; the right to request deletion of your personal information; the right to opt out of the sale or sharing of personal information or of targeted advertising; the right to limit the use of sensitive personal information; and the right to non-discrimination for exercising your privacy rights. You will not be denied services or charged a different price for exercising your rights.

You may designate an authorized agent to make a request on your behalf, subject to verification.
9.1 California Residents
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA"), grants you the rights listed above. In the preceding twelve months, we may have collected the following categories of personal information: identifiers (name, email, phone, IP address); commercial information (business status and activity); internet or network activity (browsing, Site usage); geolocation (approximate, derived from IP); professional or employment information; and inferences drawn from the foregoing. We collected this information from the sources described in Section 2 and used it for the purposes described in Section 3. We may "share" personal information with advertising and analytics partners for cross-context behavioral advertising, as defined under the CCPA. 9.2 Other State Residents

10. Children's Privacy
The Site is not directed to children under the age of 16, and we do not knowingly collect personal information from children under 16. We implement reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the Internet or method of electronic storage is one hundred percent secure, and we cannot guarantee absolute security. You are responsible for safeguarding any credentials or information you use to access the Site.
12. Data Location and International Users
We operate in the United States, and all information we collect is stored and processed in the United States. The Site is not intended for users located outside the United States. If you access the Site from outside the United States, you do so at your own initiative and are responsible for compliance with any local laws that may apply.

The Site may contain links to third-party websites, services, and platforms that are not operated by us. This Privacy Policy does not apply to those third parties, and we are not responsible for their privacy practices.
