- Process any transactions or orders
- Handle any financial information
- Directly sell or deliver flowers
All orders, payments, and transactions are processed entirely by DoorDash Online Ordering. When you complete a purchase, you are entering into a transaction with DoorDash and the applicable florist partner—not with @Flowers. DoorDash’s terms of service, privacy policy, and payment processing terms govern all transactions. We encourage you to review DoorDash’s policies before completing any purchase.

Actual product availability, pricing, and appearance are determined by DoorDash and the individual florist partners.

BY USING THIS SITE, YOU EXPRESSLY CONSENT TO THE COLLECTION, USE, STORAGE, PROCESSING, AND SHARING OF YOUR DATA AS DESCRIBED IN THESE TERMS AND OUR PRIVACY POLICY.

TO THE FULLEST EXTENT PERMITTED BY LAW, @FLOWERS, ITS OWNERS, OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY THIRD-PARTY SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.
BECAUSE @FLOWERS DOES NOT PROCESS ANY TRANSACTIONS OR ACCEPT ANY PAYMENTS, WE ARE NOT LIABLE FOR ANY ISSUES RELATED TO ORDERS, PAYMENTS, REFUNDS, DELIVERIES, OR PRODUCT QUALITY. ALL SUCH MATTERS MUST BE ADDRESSED DIRECTLY WITH DOORDASH AND/OR THE APPLICABLE FLORIST PARTNER.
OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
13. Indemnification
You agree to indemnify, defend, and hold harmless @Flowers, its owners, officers, directors, members, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, violation of these Terms, or violation of any rights of a third party.
14. Arbitration and Class Action Waiver
Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Wilmington, Delaware.
Class Action Waiver: YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. You waive any right to participate in a class action lawsuit or class-wide arbitration.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
17. Changes to Terms
We reserve the right to modify these Terms at any time in our sole discretion. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes acceptance of the new Terms. It is your responsibility to review these Terms periodically.
18. Entire Agreement
